Pursuit of Civil Liability and Filing Criminal Complaints

Overview

Pursuit of Liability of Responsible Parties

As public funds are injected into the resolution of failed financial institutions, pursuing the liability of former management of such institutions constitutes one of our key responsibilities.
With regard to the involvement of former management in loan transactions and other matters that caused the failure of the financial institution concerned, we conduct thorough investigations and evidence collection, in close coordination with the Deposit Insurance Corporation of Japan (DICJ). Based on these efforts, we pursue civil liability against former management, including filing claims for damages and initiating litigation.

Criminal Complaints, etc.

Under the Deposit Insurance Act and other relevant laws and regulations, we are obligated, in the course of its operations, to file criminal complaints when it identifies conduct suspected of constituting a crime. Accordingly, we respond rigorously to such criminal acts in close coordination with the DICJ.
In addition, RCC actively takes civil enforcement measures, including provisional dispositions, with the aim of eliminating illegal occupation of collateral properties by organized crime groups and associated parties.
